Law Enforcement Officers Safety Act 2004 (PL 108-277)
International Security Associates Inc. (ISA) offers qualification for
retired federal, state, local police officers and sheriff deputies to carry a
concealed firearm in accordance with Public Law 108-277, The Law Enforcement
Officers Safety Act 2004. Chapter 44 of Title 18 Section 926C describes the
criteria for qualified retired law enforcement officers to carry a concealed
firearm. In simplified terms this law requires an individual to meet seven
requirements in order to be considered a "qualified retired law enforcement
officer".
The requirements are:
The officer retired in good standing from service with a public agency as a law enforcement officer, other than for reasons of mental instability.
Prior to retirement, the officer was authorized by law to engage in or supervise the prevention, detection, investigation or prosecution of, or the incarceration of any person for, any violation of law and had statutory powers of arrest.
Prior to retirement, the officer was regularly employed as a law enforcement officer for an aggregate of 10 years or more; or retired from service with such agency , after completing any applicable probationary period of such service, due to a service-connected disability, as determined by such agency.
The officer has a "nonforfeitable right to benefits" under the retirement plan of the agency.
During the most recent 12-month period, the officer has met (at their personal expense) the State’s standards for training and qualification for active law enforcement officers to carry firearms.
The retired officer is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance.
The officer is not prohibited by Federal law from receiving a firearm.
ISA provides the necessary instruction and qualification as required by the
State of Ohio if the retired officer meets the above requirements. The retired
officer will receive instruction from qualified members of the ISA staff at an
indoor shooting facility located in Delaware, Ohio. There will be a fee of $40.00
for one weapon and a $25.00 fee for any additional weapons fired. The fee is to
off set the rental cost of the range and the administrative costs for the proper
credentials issued to those successfully completing the course of fire. The
retired officer is responsible for supplying the appropriate firearm, ammunition
as well as eye and ear protection. The course of fire will require 60 rounds of
ammunition. Ammunition and supplies will be available for purchase or rental at
the shooting range. The qualification sessions should last approximately two hours.
